• Payment information — When you purchase a service or pay an invoice, payment is processed by Stripe and, where applicable, Klarna. We do not collect or store your full payment card number, bank account number, or Klarna account credentials. We receive limited transaction data such as the last four digits of your card, the transaction amount, and the status of the payment.
• Client materials — If you become a client, you may share business documents, brand assets, login credentials, or other materials needed to deliver services. We treat this information as confidential.

Information Collected Automatically

When you visit the Site, we and our analytics partners automatically collect certain information about your device and how you interact with the Site, including:

• IP address, approximate location (city/region level), and time zone

• Service providers — Companies that help us operate, including Stripe and Klarna for payments, our email platform (Mailchimp or equivalent) for newsletters and client communication, our scheduling tool, our website host, and our analytics providers.
• Advertising partners — Meta and Google, in connection with measuring and optimizing campaigns we run for ourselves and our clients.
• Professional advisors — Lawyers, accountants, and consultants when needed to operate the business or comply with legal obligations.
• Legal and safety — When required by law, court order, or to protect the rights, property, or safety of Æquora Creative, our clients, or others.
• Business transfers — If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. You will be notified of any change in ownership or use of your personal information.

05Payment Processing

Payments on the Site are handled by Stripe and, when offered, by Klarna. When you pay, you are providing your payment information directly to those processors under their privacy policies and terms. We never see or store your full payment card details. Stripe and Klarna are independently responsible for the security and handling of payment data on their platforms.

06Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, remember your preferences, measure performance, and run advertising. The categories we use include:

• Strictly necessary cookies — Required for the Site to function properly. These cannot be disabled.
• Analytics cookies — Google Analytics helps us understand how visitors use the Site so we can improve it.
• Advertising cookies — The Meta Pixel and Google advertising tags help us measure and target our marketing.

Welcome to Æquora Creative. These Terms of Service ("Terms") govern your use of aequoracreative.com (the "Site") and any services we provide. By using the Site, booking a discovery call, or engaging us as a client, you agree to these Terms. If you do not agree, please do not use the Site or our services.

01About Us

Æquora Creative is a marketing agency based in Arizona, United States, providing services that may include strategy, branding, social media management, photography, video, web design, paid advertising, and consulting. Our services and pricing are described on the Site and in individual proposals or service agreements.

02Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site or engage our services. If you are using the Site or services on behalf of a company, you represent that you have the authority to bind that company to these Terms.

03The Site

The Site is provided for informational and business purposes. We may update, change, or remove content at any time without notice. We do not guarantee that the Site will always be available, error-free, or uninterrupted.

04Inquiries, Bookings, and Contracts

Submitting an inquiry form or booking a discovery call does not create a service agreement or obligate either party to anything beyond the scheduled call. A binding service relationship begins only when both parties sign a written proposal, statement of work, or service agreement (a "Client Agreement").

If there is any conflict between these Terms and a signed Client Agreement, the Client Agreement controls for that engagement.

05Payments

Payments for our services are processed through Stripe and, where offered, Klarna. By submitting a payment, you agree to the terms and privacy practices of the applicable processor in addition to these Terms.

• Agency fees: All retainer fees, project fees, and deposits described in your Client Agreement are payable to Æquora Creative.
• Media buying budget: Any advertising spend ("Media Buying Budget") is separate from our agency fees and is paid directly to advertising platforms such as Meta or Google. Media Buying Budget is never combined with the agency retainer.
• Klarna purchases: If you pay using Klarna, you are entering into a separate financing or installment agreement with Klarna. Klarna's terms govern that arrangement, including any interest, late fees, or repayment obligations. We are not a party to your agreement with Klarna.
• Late or failed payments: If a payment is late or fails, we may suspend services until the account is brought current. Repeated nonpayment is grounds for termination of the Client Agreement.
• Taxes: You are responsible for any sales tax, VAT, or similar taxes applicable to the services in your jurisdiction, unless otherwise stated in writing.

06Refunds

Because our services are creative and time-intensive, fees and deposits are generally non-refundable once work has begun. Specific refund terms, if any, are set out in your Client Agreement. Nothing in these Terms limits any rights you may have under applicable consumer protection law.

07Intellectual Property

Our Content

All content on the Site — including text, graphics, photography, video, logos, the Æquora and Æ marks, the visual identity system, and the underlying code — is owned by Æquora Creative or our licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, modify, distribute, or create derivative works from our content without our prior written permission.

Client Deliverables

Ownership of work product created for clients is governed by the applicable Client Agreement. In general, final deliverables transfer to the client upon full payment, while underlying frameworks, templates, and proprietary methodologies remain the property of Æquora Creative.

Your Materials

If you provide us with content, brand assets, logos, photographs, or other materials to use in our work for you, you represent that you own those materials or have permission to use them, and you grant us a license to use them as needed to deliver our services.

Portfolio Use

Unless your Client Agreement says otherwise, we may display work created for you in our portfolio, case studies, social media, and marketing materials, with appropriate credit.

08Acceptable Use

When using the Site or our services, you agree not to:

• Use the Site or services for any illegal, fraudulent, or harmful purpose
• Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
• Reverse engineer, scrape, or copy the Site beyond normal browsing
• Upload or transmit viruses, malicious code, or harmful content
• Misrepresent your identity or business when engaging with us
• Harass, threaten, or abuse our team in any communication

We reserve the right to refuse service or terminate any engagement at our discretion, including where a client's conduct, business practices, or values are inconsistent with the standards described in our public materials.

09Third-Party Services and Links

The Site and our services rely on third-party tools, including Stripe, Klarna, Mailchimp, Google Analytics, Meta, Google, and our scheduling and hosting providers. Those services have their own terms and privacy policies, and your use of them is subject to those terms. We are not responsible for the actions or content of any third party.

10Disclaimers

THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ÆQUORA CREATIVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Marketing involves many factors outside our control, including platform algorithms, market conditions, and audience response. We do not guarantee any specific business outcome, follower count, engagement rate, return on ad spend, lead volume, or revenue figure. Results depend on many factors, including the client's product, pricing, market, and own effort.

11Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ÆQUORA CREATIVE AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE, OUR SERVICES, OR THESE TERMS, REGARDLESS OF THE LEGAL THEORY — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR OUR SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

12Indemnification

You agree to indemnify and hold harmless Æquora Creative and its owners, employees, and contractors from any third-party claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Site or our services in violation of these Terms, (b) materials you provide to us that infringe a third party's rights, or (c) your violation of any law.

13Confidentiality

During an engagement, both parties may receive confidential information about the other. Both parties agree to protect such information, use it only for the purpose of the engagement, and not disclose it to third parties without permission, except as required by law. Specific confidentiality terms may be set out in your Client Agreement.

14Termination

We may suspend or terminate your access to the Site or any service at any time for violation of these Terms, nonpayment, or any conduct that we determine, in our reasonable discretion, to be harmful to our business, our team, or other clients. Termination of a Client Agreement is governed by that agreement. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

15Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms, the Site, or our services will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

Before filing any formal legal action, both parties agree to attempt in good faith to resolve the dispute by direct discussion for at least 30 days after written notice of the dispute is sent to admin@aequoracreative.com.

16Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. If we make material changes, we will provide reasonable notice through the Site or by email. Your continued use of the Site or our services after changes are posted means you accept the updated Terms.

17Miscellaneous

• Entire agreement: These Terms, along with any Client Agreement, our Privacy Policy, and any policies referenced here, make up the entire agreement between you and Æquora Creative regarding the Site and our services.
• Severability: If any provision of these Terms is found to be unenforceable, the rest will remain in full effect.
• No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force majeure: We are not liable for any delay or failure caused by events outside our reasonable control, including platform outages, natural disasters, or government action.
